Terms of Service

1. Agreement to Terms

By accessing and using the ARVX mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Dallas Choice Homes LLC ("Company," "we," "us," or "our").

2. Description of Service

ARVX is a real estate investment analysis tool that provides:

• Property valuation estimates (After Repair Value - ARV)
• Repair cost calculations
• Investment strategy analysis (wholesale, fix-and-flip, BRRRR, rental)
• Comparable sales and rental data
• Investment metrics and profit projections

3. Account Registration

To use ARVX, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your account information if it changes
• Accept responsibility for all activities under your account

4. Subscription Plans and Billing

Free Plan

Includes 3 unique property analyses per rolling 30-day period. Free users have access to basic features with limited data.

ARVX Pro ($24.99/month)

Subscription benefits include:

• Unlimited property analyses
• Full comparable sales and rental data
• PDF export functionality
• Advanced investment metrics

Billing Terms

• Subscriptions are billed monthly through your Apple Account
• Payment is charged at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage subscriptions and turn off auto-renewal in your Apple Account Settings
• No refunds for partial subscription periods

5. Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose or in violation of any laws
• Share your account credentials with others
• Attempt to reverse engineer, decompile, or disassemble the App
• Use automated systems (bots, scrapers) to access the App
• Interfere with or disrupt the App's functionality
• Use the App to harass, abuse, or harm others
• Violate any third-party rights, including intellectual property rights
• Republish or redistribute data obtained from the App without permission

6. Data Accuracy and Disclaimer

You acknowledge and agree that:

• ARV estimates are algorithmic predictions, not professional appraisals
• Repair costs are estimates and may vary significantly from actual costs
• Market data may be incomplete, outdated, or inaccurate
• Investment projections are hypothetical and not guarantees of future performance
• You are solely responsible for conducting due diligence before making investment decisions
• We recommend consulting with licensed real estate professionals, contractors, and financial advisors

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• WE ARE NOT LIABLE FOR ANY INVESTMENT LOSSES, DAMAGES, OR FINANCIAL HARM RESULTING FROM USE OF THE APP
• WE ARE NOT LIABLE FOR DATA INACCURACIES, SERVICE INTERRUPTIONS, OR TECHNICAL FAILURES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS

8. Third-Party Services

The App integrates with third-party services including:

• Google Places API (address autocomplete)
• RentCast API (property data and estimates)
• RevenueCat (subscription management)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service performance or data accuracy.

9. Intellectual Property

The App, including all content, features, and functionality, is owned by Dallas Choice Homes LLC and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

10. User Data and Privacy

Your use of the App is also governed by our Privacy Policy, available at arvxapp.com/privacy.html.

You retain ownership of your analysis data. We do not claim ownership of the property addresses or analysis information you enter.

11. Termination

We reserve the right to:

• Suspend or terminate your account for violations of these Terms
• Discontinue the App or any features at any time
• Modify subscription plans and pricing with 30 days notice

You may cancel your subscription at any time through your Apple Account Settings. Upon cancellation, you retain access until the end of your billing period.

12. Modifications to Terms

We may modify these Terms at any time. Significant changes will be communicated through the App or via email. Continued use of the App after changes constitutes acceptance of modified Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

14. Indemnification

You agree to indemnify and hold harmless Dallas Choice Homes LLC from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your use of the App
• Investment decisions made based on App data
• Your violation of any third-party rights

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Dallas Choice Homes LLC regarding the App.
